Terms and Conditions of Payment
Use of Accounts.
Accounts are restricted to individual users. Each user accessing the Service will have their own account and will pay applicable fees for the services they acquire.
IMMERSOUND accepts credit cards, debit cards, and virtual wallets such as Payoneer / Paypal and will automatically charge your chosen payment method for the amount of services you have selected.
IMMERSOUND may change current fees and charges, or add new fees and charges from time to time, but we will give you advance notice of these changes via email. If you wish to use a different credit card or if there is a change in the validity or expiration date of your credit card, you can edit your information by accessing your "Account" page. If your credit card reaches its expiration date, your continued use of the Service
Transactions per use
When using the service and ordering song package purchases, your account will be billed immediately to your credit card or virtual wallet for each similar transaction you make.
IMMERSOUND is not responsible for completing any transaction that cannot be approved by our payment processor, whether due to insufficient funds available on your credit card or for another reason. If this situation occurs, you will receive an error message from the Service and the transaction will be denied. Furthermore, IMMERSOUND may suspend your account and contact you to provide valid alternative credit card information to IMMERSOUND.
Unless specifically stated otherwise, all amounts set forth in this Agreement and in the Service are expressed in US dollars and exclude all applicable taxes.
Service Conditions
Thank you for using the web services of IMMERSOUND. These terms of service ("Agreement") cover your use and access to the services and websites ("Services") provided by IMMERSOUND. Our Privacy Policy explains how we collect and use your information, while our Acceptable Use Policy and Fair Use Policy describe your responsibilities when using our Services.
By using our Services, you agree to abide by the terms of this Agreement and review our Privacy Policy and Acceptable Use and Fair Use Policy. If you are using our Services for an organization, you are agreeing to the terms of this Agreement on behalf of that organization.
By using or accessing the Services, you agree to all the terms and conditions set forth in this Agreement. If, at any time, you do not agree or are unable to accept the terms of this Agreement, you must cease accessing or using the Services.
Your Assets and Your Permissions
By using our Services, you provide us with your files, content, settings, metadata, etc. ("Your Assets"). Your Assets belong to you. The terms of this Agreement do not grant us rights over Your Assets, except for the limited rights that allow us to have access to the material to create immersive mixes in DOLBY ATMOS and SONY 360 Reality Audio formats.

We work for musicians and creators. Our pricing aims to be accessible to the music community so that the largest number of users can benefit from these services.

We work for musicians! And to provide our services to you, we must collect information from you to better meet your needs. Therefore, we may collect various types of information through the services we provide. You can rest assured that we strictly use your "Personal Information" (i.e., information that personally identifies you or could be used to personally identify you) to provide the Services. Additionally, we may process Personal Information with your consent.
What you share with us
When you use our Services, you may share with us — and we may collect — Personal Information including (but not limited to) the following:
Your email address when subscribing to our blog;
Your last name, first name, email address, and postal address when creating an account;
Your payment information when purchasing a paid subscription;
Your preferred language, subscription plan, billing information, song history, and promotional codes associated with your account (where applicable);

Therefore, we may use the information we collect in many ways to provide the Services, including:

Provide you with the requested subscription services and process payment;
Access your data to store and analyze it so that you can enjoy our services;
Activate certain features, such as previews, editing, sharing, or searching songs. For example, if you allow us access to your contacts, we may store this information to simplify some of your interactions (such as sharing your data or sending emails or invitations to use our services);
Understand and analyze usage trends and preferences of our users to improve the Services and develop new products, services, features, and functionalities;
Enhance the performance of our mastering algorithm and music engine based on the music you upload. You, the musician, own the ownership, copyright, and record rights to your music;
Follow up on any questions and requests for help or information;
Understand your needs and preferences, as well as assess your level of satisfaction with our service;
Send you informative updates about our products, services, news, activities, and to follow up on our offers, promotions, and contests (e.g., send you credits for referring new customers when you recommend our services to someone), provided that applicable law allows;
Comply with legal and regulatory requirements, where applicable.
How we manage your information
IMMERSOUND may store or process your Personal Information in other countries where we have facilities or have external service providers. By using the Service, you consent to the transfer of information to countries outside your country of residence, including the United States. Therefore, your Personal Information may be subject to data protection and privacy laws different from those in your country. While your Personal Information is outside Canada, it is subject to the laws of the country where it is retained and may be subject to disclosure to governments, courts, or regulatory or security authorities of that other country, in accordance with the laws of that country.
However, our practices regarding your Personal Information will always be governed by this Privacy Policy and, where applicable, we will comply with the requirements of the General Data Protection Regulation ("GDPR"), providing adequate protection for the transfer of Personal Information from the EU/EEA to a third country. Information may also be stored locally on the devices you use to access our Services.
We store your data for as long as necessary to provide you with the services or as required by laws, regulations, or government orders. If you delete your account, we will also delete all your Personal Information. But please note that: (1) deleting this information from our servers and backup servers may take time; (2) our legal obligations may require the retention of some information. Except for paid accounts, we reserve the right to delete your account if you do not access our services for twelve (12) consecutive months. Before deleting your account, we will send a notification to your email address.

Our services are not directed at children under the age of 13, and we never knowingly collect Personal Information from children under 13 years of age. If we become aware that we have collected Personal Information from a child under 13 without prior authorization from a parent, guardian, or legal representative, we will take necessary steps to immediately delete such information.

Interfere with or disrupt any user, host, or network, for example, by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;
Plant malicious software or otherwise use the Services to distribute malicious software;
Access or search the Services by any means other than our publicly supported interfaces (e.g., "scraping");
Send unsolicited communications, promotions, or advertisements, or spam;
Make a posting that is fraudulent, deceptive, or infringes on another person's rights;
Promote or advertise products or services other than your own without proper authorization;
Impersonate or misrepresent your affiliation with any person or entity;
Post or share material that is unlawfully pornographic or indecent, or that promotes intolerance, religious, racial, or ethnic hatred;
Violate the law in any way, or violate the privacy of others, or defame others;
Attempt to decipher, decompile, disassemble, or reverse engineer any software used to provide the Service;
Harm or threaten to harm others in any way or interfere, or attempt to interfere with the access of any user, host, or network, including, without limitation, by sending a virus, overloading, flooding, spamming, or mail-bombing the Service;
Supply payment information belonging to a third party;
Use the service abusively contrary to its intended use, documentation or IMMERSOUND Audio’s reasonable instructions;
If you make material available or share it using the services without copyright or a license to do so, IMMERSOUND may remove it without notice.

Reasonable Use
IMMERSOUND has developed this policy as a guide for you to understand the intended uses of our Services and to prevent exploitation and abuse of the unlimited features offered by our plans.
Normal and Reasonable Personal or Professional Use
The service offered in our plans is intended for normal and reasonable personal or professional use. "Unlimited" refers to that type and level of use. Normal and reasonable personal or professional use does not include commercial uses, such as operating a business where you use the Services to master or release an unusually high number of tracks (for payment or otherwise) compared to the typical user for personal or professional purposes.
Notification
If IMMERSOUND determines that your usage is unusual or unreasonable, we will contact you (via the email address provided in your account) to inform you about your usage. This may be an opportunity for you to correct your usage or to offer you another plan. We also reserve the right to take any other action, including immediately suspending your account and your use of the Service or closing your account.
